Terms of Service

1. Agreement to Terms

This Terms of Service agreement (“Terms”) is entered into between you (“you”, “customer”, “subscriber”, or “user”) and QubitVPN (“QubitVPN”, “we”, “us”, or “our”) and governs your use of QubitVPN’s websites, software, applications, and related services (collectively, “Services”).

By accessing, registering for, or using any part of the Services, you accept and agree to be bound by these Terms in full. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SERVICES.

Your use of the Services also represents your legal affirmation that:

  • You are of legal age (at least 18 years old or age of majority in your jurisdiction);

  • You have the capacity and authority to enter into legally binding agreements.

 

 

2. Changes to Terms

We reserve the right to revise, amend, or update these Terms at any time, with or without notice. The latest version will always be posted on our website. Continued use of the Services after any such changes constitutes your binding acceptance of the modified Terms.

 

 

3. Nature of Services

QubitVPN provides encrypted VPN (Virtual Private Network) services to increase online privacy, anonymity, and access to geo-restricted content. We do not guarantee identity masking, complete data security, perfect anonymity, or uninterrupted service.

The Services are not intended to be used as a complete security solution.

 

 

4. User Obligations

You agree to:

  • Maintain accurate account information and safeguard your credentials;

  • Use the Services only for lawful purposes;

  • Be solely responsible for all activity occurring under your account.

You must not:

  • Use the Services to commit, facilitate, or promote illegal acts;

  • Violate intellectual property laws;

  • Use the Services for spam, fraud, abuse, DDoS attacks, malware, or surveillance;

  • Attempt to probe, scan, or breach the Services or network infrastructure.

QubitVPN reserves the right to monitor traffic patterns and resource usage to prevent abuse, within legal limits.

 

 

5. Prohibited Uses

Use of the Services is expressly prohibited for:

  • Child exploitation or abuse

  • Human trafficking or stalking

  • Phishing, scamming, or identity theft

  • Hosting or distributing pirated content or counterfeit goods

  • Unauthorized port scanning or hacking

  • Any act that violates applicable laws or regulations in Tennessee, the United States, or your jurisdiction.

Violation may result in immediate termination of access with no refund and potential notification to appropriate authorities.

 

 

6. Billing and Subscription Terms

QubitVPN services are prepaid. All charges are due before service is activated or renewed. All prices are in U.S. Dollars and are subject to change at any time.

Refund Policy

Unless otherwise stated, all payments are final and non-refundable. We may, at our sole discretion, issue refunds on a case-by-case basis.

Chargebacks

Initiating a chargeback will result in immediate suspension or permanent ban of your account and associated IPs. You agree to pay any collection and legal fees resulting from chargebacks or reversed payments.

 

 

7. No Warranty

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER TENNESSEE LAW, QUBITVPN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The Services will be available, uninterrupted, or error-free;

  • Your data will remain private from all forms of surveillance or compromise;

  • Any specific website, service, or application will be accessible via QubitVPN.

Use of QubitVPN does not grant you immunity from legal obligations, jurisdictional law, or third-party policies.

 

 

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER LAW, IN NO EVENT SHALL QUBITVPN, ITS OWNER(S), EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES INCLUDING, BUT NOT LIMITED TO:

  • LOST PROFITS

  • LOSS OF DATA

  • BUSINESS INTERRUPTION

  • UNAUTHORIZED ACCESS TO OR USE OF SERVERS OR SYSTEMS

  • DAMAGE TO DEVICES OR NETWORKS

TOTAL LIABILITY TO YOU SHALL NEVER EXCEED THE AMOUNT PAID BY YOU TO QUBITVPN IN THE LAST SIX (6) MONTHS. THIS LIMITATION APPLIES TO ALL CLAIMS IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

 

9. Indemnification

You agree to indemnify, defend, and hold harmless QubitVPN and its affiliates, owners, contractors, and agents from and against all losses, liabilities, claims, damages, costs, and expenses (including attorney’s fees) arising out of:

  • Your use or misuse of the Services;

  • Your violation of these Terms;

  • Any content transmitted via the Services under your account.

 

 

10. Termination

QubitVPN reserves the right to suspend or terminate your account or access to the Services at any time, for any reason, with or without notice, especially in the event of:

  • Violation of these Terms;

  • Fraudulent or abusive behavior;

  • Failure to pay applicable fees;

  • Legal obligation or law enforcement request.

All terminations are final. No refunds will be issued upon termination except where required by law.

 

 

11. Jurisdiction and Governing Law

These Terms and any disputes arising from them or the Services shall be governed by and construed in accordance with the laws of the State of Tennessee, excluding conflict-of-law principles. The parties agree that the exclusive venue for any legal action shall be the state or federal courts in Davidson County, Tennessee.

 

 

12. Binding Arbitration and Waiver of Class Actions

A. Mandatory Arbitration

Any controversy or claim arising out of or relating to these Terms or your use of the Services shall be resolved by final and binding arbitration conducted under the rules of the American Arbitration Association (AAA). Arbitration shall be held in Davidson County, Tennessee, in English, before a single arbitrator. You agree:

  • To waive the right to a trial by jury;

  • That arbitration is the exclusive method of dispute resolution;

  • That you shall not bring claims as part of a class, collective, or representative action.

B. Exceptions

Either party may bring individual claims in small claims court, or seek temporary injunctive relief in a court of competent jurisdiction for immediate, irreparable harm.

 

 

13. Force Majeure

QubitVPN shall not be liable for any failure to perform due to causes beyond our control, including but not limited to: war, strike, natural disaster, pandemic, power failure, internet outage, changes in law, or acts of God.

 

 

14. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.

 

 

15. Severability

If any part of these Terms is found to be unlawful, void, or unenforceable, that portion shall be severed, and the remainder shall remain in full force and effect.

 

 

16. Entire Agreement

These Terms, along with our Privacy Policy and any other documents incorporated by reference, constitute the full agreement between you and QubitVPN and supersede all prior agreements or representations.

 

 

17. Legal Entity Disclosure

By using QubitVPN, you acknowledge that the Services are offered and operated by an individual based in Tennessee and not a corporation, LLC, or other registered entity. You expressly waive any presumption that QubitVPN is a formal legal business structure. Legal claims, responsibilities, and liabilities are assumed solely in the context of an individual offering services and not a separate legal person.
